Yesterday, the Syracuse district attorney indicated that allegations made by Zachary Tomaselli claiming that he was molested by Bernie Fine in Pittsburgh in 2002 were not credible.  Despite the negative publicity, Tomaselli filed suit today in Allegheny County, Pennsylvania against Fine.  The lawsuit claims that Tomaselli was sexually molested by Fine in 2002 when he was thirteen years old.  The complaint provides very little detail and merely states that Fine engaged in “unpermitted, harmful, and offensive sexual conduct and contact” with Tomaselli and such acts caused Tomaselli to suffer “great pain of his mind and body, shock, emotional distress, physical manifestations of emotional distress, embarrassment, loss of self-esteem, disgrace, humiliation, and loss of enjoyment of life.”  As a result, he seeks damages in accordance with causes of action for child sexual abuse and intentional infliction of emotional distress.

Tomaselli retained the same attorney as the alleged victim who filed suit against Jerry Sandusky.
