On May 18, 2011, NCAA President, Mark Emmert, responded to Assistant Attorney General Christine Varney’s request for the NCAA’s position on the BCS.  In a short two page response, President Emmert stated “inasmuch as the BCS system does not fall under the purview of the NCAA, it is not appropriate for me to provide views on the system.  With regard to the Association’s plans for an NCAA FBS football championship, there are no plans absent direction from our membership to do so.”  In turn, President Emmert indicated the NCAA has “no role to play in the BCS” and, therefore, directed the DOJ to the BCS to determine whether “the interest of fans, colleges, universities, and players” are being adequately served.
